Nesvrta LLC Terms of Use

These Terms of Use (the “Terms”) govern your access to and use of the website at nesvrta.com (the “Site”), operated by Nesvrta LLC (“Nesvrta,” “we,” “us,” or “our”), a Maryland limited liability company. By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

These Terms cover the Site only. Any mobile applications published by Nesvrta LLC, and any consulting engagements with Nesvrta LLC, are governed by their own separate agreements.

1. The Site

The Site is an informational marketing website describing Nesvrta LLC and its work. The Site does not offer user accounts, does not accept user-submitted content, and does not process payments. Content on the Site is provided for general informational purposes only and does not constitute professional, legal, financial, or medical advice.

2. Acceptable Use

You agree not to:

• Access the Site by automated means at a volume or frequency that burdens or disrupts it, or scrape its content for redistribution
• Attempt to gain unauthorized access to the Site, its hosting infrastructure, or any related systems
• Interfere with the operation or security of the Site
• Use the Site for any unlawful purpose or in violation of any applicable law or regulation
• Misrepresent your affiliation with Nesvrta LLC

3. Intellectual Property

The Site and all of its content — including text, layout, design, graphics, and the Nesvrta name, wordmark, and logo marks — are owned by Nesvrta LLC and protected by copyright, trademark, and other intellectual property laws. “Nesvrta” and “MealPause” are names and marks of Nesvrta LLC.

You may view and browse the Site for personal or internal business purposes. You may not reproduce, distribute, modify, or create derivative works from Site content, or use the Nesvrta name or marks, without our prior written permission, except as permitted by applicable law (including fair use).

4. Disclaimer of Warranties

THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. NESVRTA LLC DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY INFORMATION ON THE SITE IS COMPLETE, ACCURATE, OR CURRENT.

5. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, NESVRTA LLC AND ITS MEMBERS, OFFICERS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT WILL NESVRTA LLC’S AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SITE EXCEED ONE HUNDRED U.S. DOLLARS (US $100).

Some jurisdictions do not allow the exclusion or limitation of certain damages; in those jurisdictions, the above limitations apply to the fullest extent permitted by law.

6. Indemnification

You agree to indemnify and hold harmless Nesvrta LLC from and against any claims, liabilities, damages, and expenses (including reasonable attorneys’ fees) arising out of your violation of these Terms or your misuse of the Site.

7. Third-Party Sites

The Site may reference or link to third-party websites or services that Nesvrta LLC does not control. We are not responsible for their content, policies, or practices.

8. Minors

The Site is not directed to persons under 18 years of age. By using the Site, you represent that you are at least 18 years old or are using the Site under the supervision of a parent or legal guardian.

9. Changes to These Terms

We may update these Terms from time to time. When we do, we will change the “Effective date” at the top of this page. Your continued use of the Site after changes take effect constitutes acceptance of the updated Terms.

10. Governing Law and Disputes

These Terms and any dispute arising out of or relating to the Site are governed by the laws of the State of Maryland, USA, without regard to its conflict-of-law rules. You agree that any such dispute will be brought exclusively in the state or federal courts located in Maryland, and you consent to their jurisdiction.

11. Miscellaneous

If any provision of these Terms is held unenforceable, the remaining provisions remain in full force. These Terms are the entire agreement between you and Nesvrta LLC regarding the Site. Our failure to enforce any provision is not a waiver of it.
